Our firm’s insurance defense and coverage practices are comprehensive. They cover matters that range across the entire spectrum of insurance interests, from motor vehicle accidents and premises liability to insurance coverage disputes and bad faith claims.
Over the past decade, the firm has gained a national reputation in numerous areas of its insurance coverage practice. The firm has acted as coordinating counsel for a major insurance company and represents numerous insurers on a regional basis. The firm’s attorneys routinely handle declaratory judgment actions involving all types of insurance policies.
We represent insurers in a wide variety of insurance coverage areas including environmental, products liability, fidelity and surety, toxic substances, construction defects, directors and officers, errors and omissions and professional negligence, employment, sexual harassment, antitrust, intellectual property, securities fraud and the emerging areas of claims for business torts. We also have counseled clients on programs to comply with state-fair-claims practices acts.
The firm’s insurance defense practice includes the defense of insureds in cases involving industrial accidents, products liability, toxic torts, construction defects, professional liability, and completed operations. We handle all aspects of no-fault insurance coverage, including matters involving PIP benefits and issues concerning collateral sources, the primacy of coverage, and subrogation, as well as uninsured and underinsured motorist coverage claims.
The firm also has significant experience defending suits alleging wrongful discharge, sexual harassment, and other claims in the emerging area of business torts. Our practice in those areas includes both trial and appellate work in both state and federal courts.
In products liability matters, the firm represents a varied group of business entities, ranging from major manufacturers to individual entrepreneurs. The clients we represent manufacture and distribute pharmaceuticals, chemicals, automobiles, industrial machinery, construction equipment, alarm and signaling systems, food processing machines, and household products. The firm also handles toxic-tort suits related to exposure from chemicals, asbestos, silica, aluminum, hazardous waste, underground storage tanks, and air and water pollution.
In the professional liability area, the firm represents lawyers, engineers, architects, and insurance agents in actions alleging professional negligence. In the legal malpractice field our firm has represented attorneys accused of mishandling the representation of clients in such contexts as collections, personal injury, banking and securities, commercial transactions, and subrogation. Our practice also includes representing insurers in declaratory judgment actions and assisting our insurer-clients in support of disclaimers and in other non-litigated claims matters.
In the environmental area, the firm represents insurance companies in all aspects of litigation and administrative proceedings. Our experience includes representing clients in toxic-tort litigation penalty and enforcement matters and permitting and compliance controversies concerning both state and federal statutes and regulations, including CERCLA, RCRA, ISRA, the Underground Storage Tank Act, Spill Compensation and Control Act, federal and state Wetlands Acts, TSCA, and the Air Pollution Control Act.
In addition, attorneys in our insurance services group represent insurers and reinsurers in both corporate and regulatory matters involving property, casualty, life, and health insurance. We have handled matters that include issues of policy drafting, insurance practices, policy interpretation, claims administration, and government regulations. We have also counseled insurers and reinsurers on mergers and acquisitions, start-ups, captive companies, licensing, regulatory compliance, and product development.
