The firm has an extensive environmental practice. We handle complex environmental litigation and administrative proceedings for clients of all sizes, including multi-national corporations, as well as closely-held corporations. We counsel clients on all aspects of the impact of environmental law in real estate and business transactions, focusing on minimizing environmental liabilities through investigations and pre-acquisition environmental audits, disclosure obligations and ISRA compliance. We negotiate New Jersey Spill Act, Federal Superfund, and private cost-recovery settlements. We also work with our clients and their consultants to develop and obtain regulatory approvals for cost effective solutions to the investigation and remediation of environmentally impacted properties, including Brownfields redevelopment projects. We draft commercial and transactional documents, including environmental provisions associated with real estate purchase contracts and leases, asset and stock purchase agreements, access agreements and environmental service agreements.
Our experience also includes representing clients in environmental and toxic tort litigation, penalty and enforcement matters, natural resource damage claims and permitting and compliance controversies concerning both state and federal statutes and regulations, including CERCLA, RCRA, ISRA, the Underground Storage Tank Act, the Spill Compensation and Control Act, the Federal and State Wetlands Acts, TSCA, and the Air Pollution Control Act; and we aid numerous lending institutions in assessing environmental risks associated with financing arrangements and in developing risk assessment policies. We also assist clients in complying with the myriad of OSHA standards and handling OSHA enforcement matters.
